TERMS OF SALES

Eliane Pouhaer, painter, produces, reproduces and sells her own works of art and guarantees the authenticity of her original works or of her works reproduced by her services or by a duly authorized third party. The signatures of the work and of the attached certificate of authenticity are mandatory. In all cases, it is agreed that the artist remains fully and unconditionally the owner of all his copyright.

1. Preamble
These general conditions of sale apply to all sales made on the website www.elianepouhaer.com They express all the obligations of the parties within the framework of the online sale of products offered by Eliane Pouhaer and any natural person. wishing to subscribe to the services of this site hereinafter referred to as “purchaser”.

The customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization or guardianship allowing him to carry out a transaction on the site www.elianepouhaer.com. By confirming his order, the buyer acknowledges having read these general conditions of sale and accept them without reservation in their entirety.

Eliane Pouhaer reserves the right to modify these general conditions of sale at any time. In this case, the applicable conditions will be those in force on this site on the date of the order.

 

2 -Order

Any order validated by the buyer on the artist's site constitutes full acceptance thereof and the validation constitutes an electronic signature which is valid between the handwritten signature parts.

The conclusion of the contract will only be effective upon confirmation of the order sent by email to the buyer. This validation will include the characteristics of the work, delivery times and shipping costs to be added to the initial price.

If it is an order for a work not yet produced, the completion deadlines will be specified during the request. A delay will not give rise to any reimbursement.

The information provided by the buyer when ordering is binding on the buyer. In the event of an error in her contact details or an incomplete address, Eliane Pouhaer cannot be held responsible for the impossibility of delivery.

 

3 - Prices

The prices of the products are indicated in euros all taxes included. Eliane Pouhaer, taxed according to the basic franchise regime, automatically benefits from a VAT exemption: VAT not applicable, article 293 B of the CGI excluding shipping costs.

The delivery costs (packaging and shipping) are the responsibility of the buyer and will be specified when ordering.

 

4 - Payment

Payment is made when ordering:

- Or by credit card (if purchased at the workshop)

- Either by check (only for France) made out to "Eliane Pouhaer" or

- Or by bank transfer: make a request on "contact@elianepouhaer.com", Eliane Pouhaer will send him an email in return.

bank details so that the buyer can proceed with the transfer.

 

5 - Delivery

The delivery zones are France, the countries of the European Union and the French overseas departments and territories. In the event of an order to a country other than mainland France, the buyer is the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are in no way incumbent on Eliane Pouhaer. They will be borne by the buyer and are his sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in his country.

Any delays do not entitle the buyer to claim damages.

After validation, orders will be shipped by La Poste within an indicative period of 2 to 5 working days, for all products on the site and not mentioning any completion time.

Under no circumstances can the seller be held responsible for loss or damage by the postal services.

It is possible to collect the order at the JOURET workshop 13 rue de l'Hospice 59100 Roubaix in which case the buyer will not have to bear the shipping costs. In this case it is necessary to make an appointment by sending a message to contact@elianepouhaer.com .

 

6 - Guarantee

In accordance with the provisions of article L.121-21 of the Consumer Code, the buyer has a withdrawal period of 14 days from receipt of the works to exercise this right without having to pay a penalty. Returns are to be made by the buyer under the same conditions as for receipt (packaging, shipping costs, etc.). In this context, the buyer's responsibility is engaged. Any damage suffered by the work on this occasion may override the right of withdrawal. The return costs are the responsibility of the buyer. As soon as the buyer has exercised his right of withdrawal within the time limit, Eliane Pouhaer undertakes to reimburse him for all the sums paid, with the exception of the shipping and return costs, within 14 days of his request for withdrawal.

If, however, the buyer prefers the exchange with another work rather than the reimbursement of the sums paid, the shipping costs of the latter will be at his expense.

 

7 - Protection of personal data

The data collected during the order is only used to process it. They are reserved for internal use and in no case will be resold or transferred to a third party.

The customer has (article 34 of the law of January 6, 1978 and updated by the RDGPD law of June 20, 2018 which extends the protection of these data to the European level) a right of access, modification, rectification and deletion of data concerning him that he can exercise with Eliane Pouhaer 13 rue de l'Hospice 59100 Roubaix - France or by email at contact@elianepouhaer.com

 

8 - Rights and ownership of works

All the elements of the site www.elianepouhaer.com, all texts, literary data, graphics, photographs, sound and works presented on the site are protected by copyright and intellectual property.

Unless expressly authorized in writing, reproduction and any use of the works other than individual and private consultation are prohibited.

The artist retains all rights to reproduce his works.

Any reproduction, representation, use or modification by any process and on any medium whatsoever of all or part of a creation, without having previously obtained the written consent of Eliane Pouhaer, is strictly prohibited and constitutes an offense of counterfeiting.

 

9 - Litigation

The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, and in the absence of an amicable agreement between the parties, the French courts will have sole jurisdiction.
